OPINION:
[The Commission by Chairman Hyde and Commissioners
Cox, Loevinger and Wadsworth granted the above described application on
September 13, 1967. Commissioner Lee dissented and issued the following
statement in which Commissioner Johnson joined.]

STATEMENT OF COMMISSIONER ROBERT E. LEE IN WHICH COMMISSIONER JOHNSON JOINS
I dissent to the action taken by the Commission
whereby it waived the adjacent channel separation requirements for UHF
stations. To my mind the waiver has not been justified by the applicant who
claims that operation from a site meeting spacing requirements would result in
a marginal city grade service to Lafayette. This claim is inadequately
supported.
Even if adjacent channel spacings were met with
equal facilities, each station would be capable of rendering interference-free
service, on a line between
stations to a distance of only 27-1/2 miles.
In view of the fact that our studies show that
other channels which would meet all separation requirements are available in
this area, it would seem short-sighted and inconsistent with the best
development of UHF service to permit this rule violation that the Commission
condones.
